HOUSE BILL 2640
AN ACT amending the charter of the city of durham to allow the city council to delegate to the city manager the authority to conclude the sale and conveyance of real property.
The General Assembly of North Carolina enacts:
SECTION 1. The Charter of the City of Durham, being Chapter 671 of the 1975 Session Laws, as amended, is amended by adding the following new section to read:
"Sec. 86.3. City Manager authorized to conclude the sale of real property. The city council may after authorizing the sale of real property under the provisions of Article 12 of Chapter 160A of the General Statutes delegate to the city manager the power to take any action that the city council is required or allowed to take to conclude the sale and conveyance of the real property, including accepting and confirming bids and offers, requiring deposits, publishing notices and advertisements, receiving reports of bids, and rejecting all bids and offers. The city manager shall within 45 days following the acceptance of a bid or a similar final determination, made within the discretion of the city manager, submit to the city council a written report setting forth a legal and general description of the property, the purchase price, and the names of the persons to whom the property will be or has been conveyed. The city manager's authority under this section is in addition to and not limited by any other authority granted to the city manager under the provisions of this charter or any general, special, or local law."
SECTION 2. This act is effective when it becomes law.
