AN ACT TO PROVIDE THAT FAILURE TO TAKE THE OATH OF OFFICE AS A MEMBER OF A LOCAL BOARD OF EDUCATION BY THE FIRST MONDAY IN DECEMBER DOES NOT CREATE A VACANCY.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S.  115C-37(d) is amended by deleting "A failure to qualify within that time shall constitute a vacancy which shall be filled as set out in subsection (f) of this section.  Those persons appointed to fill a vacancy must qualify within 30 days after notification.  A failure to qualify within that time shall constitute a vacancy."

Sec. 2.  The first sentence of G.S. 115C-37(d) is deleted and the following substituted:  "Each county board of education shall hold a meeting in December following the election.  At that meeting, newly elected members of the board of education shall qualify by taking the oath of office prescribed in Article VI, Section 7 of the Constitution."

Sec. 3.  This act is effective upon ratification.
