GENERAL ASSEMBLY OF NORTH CAROLINA

CHAPTER 432
AN ACT REGARDING THE AUTHORITY OF THE CITY OF WILMINGTON TO REQUIRE A CERTIFICATE OF APPROPRIATENESS FOR EXTERIOR WORK TO STRUCTURES IN AN AREA DESIGNATED AS AN HISTORIC DISTRICT OVERLAY.
The General Assembly of North Carolina enacts:
Section 1. The Charter of the City of Wilmington, being Chapter 495, Session Laws of 1977, is amended by adding a new section to read:
"Sec. 23.8. Certificates of appropriateness in an area designated as an historic district overlay.
Notwithstanding the provisions of G.S. 160A-397, the City Council of the City of Wilmington may by ordinance require the issuance of a certificate of appropriateness for exterior changes visible only from public rights-of-way, excluding alleys, within historic districts which overlay other zoning districts. For purposes of this section, an exterior change may include one or more of the items defined in G.S. 160A-397 as 'exterior features'."
Sec. 2. This act is effective upon ratification.
