AN ACT CONCERNING THE LOCATION OF ABC HEARINGS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Article 4 of Chapter 18A of the General Statutes is hereby amended by adding a new section as follows:

"§ 18A-44.1.  Location of hearing. — The hearing held by a hearing officer shall be held in the following localities: Ahoskie, Asheville, Charlotte, Elizabeth City, Fayetteville, Franklin, Goldsboro, Greensboro, Greenville, Hickory, Jacksonville, Kinston, New Bern, Raleigh, Statesville, Wilmington and Winston-Salem. Such hearing shall be held no more than 100 miles, as can reasonably be determined by the ABC Board, from the county seat of the county in which any person whose property or rights are the subject matter of the hearing maintains his residence. In any case, the person whose property or rights are the subject of the hearing and the State board may agree that the hearing is to be held in some other location. The location of hearings held under the authority of G.S. Chapter 18A shall be governed by this section, notwithstanding the provisions of the Administrative Procedure Act as contained in G.S. Chapter 150A."

Sec. 2.  This act shall become effective July 1, 1975.
