HOUSE BILL 914

 

AN ACT TO AMEND CHAPTER 199, PRIVATE LAWS OF 1889, TO PROVIDE FOR THE ELECTION OF THE MAYOR AND BOARD OF COMMISSIONERS IN THE TOWN OF BLOWING ROCK.

 

The General Assembly of North Carolina enacts:

 

Section 1. Section 3 of Chapter 199, Private Laws of 1889, is rewritten to read:

"Sec. 3. The elective officers of the Town of Blowing Rock shall be a Mayor and a Board of Commissioners consisting of five members. The Mayor shall be elected for a term of two years and the Commissioners shall be elected for staggered terms of four years as herein provided. The municipal elections shall be held on Tuesday after the first Monday in November, 1973, and every two years thereafter. The municipal elections shall be nonpartisan and decided by a simple plurality.

In the 1973 elections, the three candidates for Commissioner receiving the highest number of votes shall be elected for a term of four years and the two candidates for Commissioner receiving the next highest number of votes shall serve for two years. Thereafter, as the terms of the members expire, their successors shall be elected for terms of four years.

The Commissioners and Mayor shall take office and their terms shall commence on the first Monday in December after their election.

The municipal elections shall be held and conducted by the municipal Board of Elections under the applicable provisions of Articles 23 and 24 of Chapter 163 of the General Statutes."

Sec. 2. Chapter 199, Private Laws of 1889, is amended by rewriting Sec. 4 to read:

"Sec. 4. Any resident of the Town who is a qualified voter shall be eligible to office and to vote in the municipal elections."

Sec. 3. This act is effective upon ratification.
