AN ACT TO ESTABLISH DISTRICTS FOR THE SELECTION OF MEMBERS OF THE MOORE COUNTY BOARD OF EDUCATION AND TO PROVIDE FOR STAGGERED TERMS.

 

The General Assembly of North Carolina do enact:

 

Section 1. That Sections 3 (b), 3 (c), 3 (d), and 3 (e) of Chapter 1051 of the 1965 Session Laws and House Bill No. 54 of the 1967 Session Laws, ratified February 23, 1967, are hereby repealed.

Sec. 2. That on and after first Monday in December, 1968, the Moore County Board of Education shall consist of eight members to be elected as set forth in this Act. One member shall be elected from each of the seven school election districts created by Section 3 of this Act and one shall be an at large member who must be a resident of the area comprising districts numbered One, district numbered Two and district numbered Three as those districts are hereinafter defined. All elections shall be nonpartisan, shall be held at the time hereinafter set forth and no party affiliation shall be designated on the ballot for any candidate. The Moore County Board of Elections shall prepare a separate ballot for use in voting for all candidates for the Moore County Board of Education to be designated, "Official Nonpartisan County Ballot for Board of Education."

Sec. 3. For the purpose of electing seven district members and the one at large member of the Moore County Board of Education, there is hereby created seven school election districts in Moore County to be comprised of the boundaries, as they now exist, of the Southern Pines City Administrative Unit, the Pinehurst City Administrative Unit and the nine attendance areas, sometimes called school areas and school districts, within the Moore County Administrative Unit. The school election districts shall be numbered One, Two, Three, Four, Five, Six and Seven and shall be comprised as follows:

(a)       District No. One shall consist of the territory which now comprises the Aberdeen School attendance area which is described in official Minute Book No. 6, page 395, of the Moore County Board of Education.

(b)       District No. Two shall consist of the territory which now comprises the Southern Pines City Administrative Unit which is described in official Minute Book No. 6, page 397, of the Moore County Board of Education.

(c)       District No. Three shall consist of the territory which now comprises the Pinehurst City Administrative Unit and the territory which now comprises the West End school attendance area which are described in official Minute Book No. 6, pages 395-399, of the Moore County Board of Education.

(d)       District No. Four shall consist of the territory which now comprises the Westmoore and Highfalls school attendance areas which are described in official Minute Book No. 7, pages 27-29 and page 31, of the Moore County Board of Education.

(e)       District No. Five shall consist of the territory which now comprises the Robbins school attendance area which is described in official Minute Book No. 7, page 29, of the Moore County Board of Education.

(f)        District No. Six shall consist of the territory which now comprises the Carthage and Cameron school attendance areas which are described in official Minute Book No. 6, pages 387-391, of the Moore County Board of Education.

(g)       District No. Seven shall consist of the territory which now comprises the Farm Life and the Vass-Lakeview school attendance areas which are described in official Minute Book No. 6, pages 393-395, of the Moore County Board of Education.

The boundaries of the Southern Pines Administrative City Unit, the Pinehurst City Administrative Unit and the nine attendance areas within the Moore County Administrative Unit are also fully described and delineated on a map entitled, "Moore County, North Carolina", prepared by R. E. Wicker, 1961, which map is now on file in the office of Superintendent of the Moore County Schools to which reference may be made.

Sec. 4. At the primary to be held in 1968 there shall be elected one member from each of the seven school election districts as defined in Section 3 of this Act and also one at large member who must be a resident of the area comprising districts No. One, No. Two or No. Three. Every district candidate for membership on said board must be a resident of the district from which he seeks election and every at large candidate for membership on said board from the area comprising districts No. One, No. Two and No. Three shall declare, at the time he files notice of his candidacy, whether he is a district candidate for the district in which he resides or whether he is an at large candidate from said three districts. All candidates for membership on said board shall be voted upon and elected in the primary election by the voters of the entire county voting at large. All elections shall be held pursuant to the provisions of Chapter 163 of the General Statutes of North Carolina relating to primary elections, except as otherwise provided in this Act. In the event, however, of a tie vote between any two candidates in a second election, no third election shall be held but the Moore County Board of Commissioners shall, within ten days following a canvass of the votes, determine by resolution duly adopted, which candidate shall be elected and upon such determination said candidate shall be the duly elected member to said board.

Sec. 5. In the election to be held in the primary in 1968, the four district candidates receiving the highest number of votes shall serve for a term of four years each and the three district candidates receiving the next highest number of votes shall serve for a term of two years each. The at large candidate, elected in the primary of 1968, shall also serve for a period of two years. In the event two or more district candidates are tied as the fourth highest candidate, the Moore County Board of Commissioners shall, within ten days following a canvass of the votes, designate by resolution duly adopted which candidate shall serve for four years and which candidate shall serve for two years.

Sec. 6. At the 1970 primary, and quadrennially thereafter, there shall be elected three district members of the Moore County Board of Education for the districts represented by those persons whose terms then expire. At the 1970 primary, and quadrennially thereafter, there shall be elected one member at large from the area comprising districts numbered One, Two and Three. At the 1972 primary, and quadrennially thereafter, there shall be elected four district members of the Moore County Board of Education for the districts represented by those persons whose terms then expire. All members of the Moore County Board of Education elected in any year in which a primary is held for the purpose of filling a vacancy caused by an expired term or terms shall take office on the first Monday in December of the year in which they are elected.

Sec. 7. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 8. This Act shall be in full force and effect from and after its ratification.
