AN ACT TO AMEND G.S. 20-309(c), 20-309(e), 20-310, AND 20-311 TO REMOVE THE REQUIREMENT THAT OPERATORS LICENSE BE SUSPENDED WHEN FINANCIAL RESPONSIBILITY IS NOT IN EFFECT, TO INCREASE THE PERIOD OF REVOCATION OF VEHICLE REGISTRATION WHEN FINANCIAL RESPONSIBILITY IS NOT IN EFFECT AND TO CLARIFY PROCEDURES FOR SURRENDER OF REGISTRATION PLATES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Subsection (c) of G.S. 20-309, as the same appears in the 1965 Replacement Volume 1C of the General Statutes, is amended by deleting the words "and suspend his operator's license for 30 days" appearing in line 6 and inserting in lieu thereof the words "for 60 days", and by deleting the figures "30" appearing in line 10 and inserting in lieu thereof the figures "60", and by deleting in line 10 the words, "and operator's license".

Sec. 2.  Subsection (e) of G.S. 20-309, as the same appears in the 1965 Replacement Volume 1C of the General Statutes, is hereby amended by deleting the fourth sentence beginning with the words "Failure by the owner" appearing in lines 12 and 13 and ending with the words "for 30 days" appearing in line 18, and inserting in lieu thereof the following:

"Failure by the owner to certify that he has financial responsibility as herein required shall be prima facie evidence that no financial responsibility exists with regard to the vehicle concerned and, unless the owner's registration plate has been surrendered to the Department of Motor Vehicles by surrender to an agent or representative of the Department of Motor Vehicles and so designated by the Commissioner of Motor Vehicles or depositing the same in the United States mail, addressed to the Department of Motor Vehicles, Raleigh, North Carolina, the Department of Motor Vehicles shall revoke the owner's registration plate for 60 days.", and by deleting the figures "30" appearing in line 21 and inserting in lieu thereof the figures "60", and by deleting in line 22 the words "and operator's license."

Sec. 3.  Subsection (a) of G.S. 20-310, as the same appears in the 1965 Replacement Volume 1C of the General Statutes, is amended by deleting the words "license plate and suspension of driver's license" appearing in line 13 and inserting in lieu thereof the words "registration plate", and by deleting the words and figures "thirty (30)" appearing in line 13 and inserting in lieu thereof the figures "60".

Sec. 4.  G.S. 20-311, as the same appears in the 1965 Replacement Volume 1C of the General Statutes, is amended by deleting from the Section title the words "and driver's license", and by deleting the words "and suspend the operator's and chauffeur's licenses of the owner thereof for a period of thirty (30) days" appearing in lines 5 and 6 and inserting in lieu thereof the words "for 60 days", and by deleting the words "the operator's or chauffeur's license of such owner be reinstated nor shall" appearing in line 7 thereof, and by deleting the words and figures "thirty (30)" appearing in line 10 and inserting in lieu thereof the figures "60", and by deleting the words "and operator's or chauffeur's license" appearing in line 11.

Sec. 5.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6.  This Act shall become effective upon its ratification.
