AN ACT TO PROVIDE FOR THE NOMINATION AND ELECTION OF THE MEMBERS OF THE BOARD OF EDUCATION OF CARTERET COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Education of Carteret County shall consist of five members who shall be nominated and elected as hereinafter set forth. For the purposes of the nomination of the members of the Board of Education of Carteret County the territorial districts heretofore established and used for the Board of County Commissioners of Carteret County, consisting of four districts, shall be used as the nominating districts for the members of the Board of Education of Carteret County.

Sec. 2. At the primary election to be held in the year 1968, for the nomination of County officers there shall be nominated two candidates from each of the two major political parties in District No. 1 and two candidates in District No. 2. Any eligible elector residing in District No. 1 or District No. 2 may become a candidate for nomination in behalf of his political party by filing notice of candidacy within 30 days of the primary with the Board of Elections of Carteret County, which notice shall state his name, age, place of residence and political party with which he affiliates, and which shall be accompanied by a filing fee of five dollars ($5.00). The primary election shall be conducted according to the laws applicable to primaries in Carteret County and as provided by Chapter 163 of the General Statutes, as amended. The candidates filing from each of the districts shall be voted on by the voters of each particular district for which the candidate files for nomination. The candidate of each political party receiving the highest number of votes in his particular district shall be declared to be nominated. At the general election to be held in Carteret County for the year 1968, the candidates so nominated shall be voted upon by the electors of the County at large. The candidates elected in the general election of 1968, from District No. 1 and District No. 2, shall take office and qualify on January 1, 1969, and shall hold office for terms of four years each or until their successors are elected and qualified.

Sec. 3. In the primary election to be held in the year 1970, for the nomination of candidates for County officers, there shall be nominated three candidates from each major political party in Districts Nos. l, 3 and 4. The filing of notice of candidacy, filing fees and other procedure as set forth above for Districts No. 1 and No. 2 shall be followed in the primary of 1970. One candidate from each political party shall be nominated from each of these three districts. The candidate shall be voted upon in each particular district from which he files, and the candidate receiving the highest number of votes shall be the nominee of his party. The candidates so nominated shall be elected in the general election for the year 1970, and shall take office on January 1, 1971, and shall serve for terms of four years each or until their successors are elected and qualified. The candidates in the general election shall be voted upon by the electors of Carteret County at large.

Sec. 4. In case of a vacancy on the Board of Education of Carteret County caused by death, resignation, change of residence, failure to qualify, or for any other cause whatsoever, the vacancy shall be filled for the unexpired term by the executive committee of the political party in power in Carteret County, and such appointment shall be for the unexpired term of the member causing the vacancy, and said vacancy shall be filled within 30 days from the date the vacancy occurs.

Sec. 5. The Chairman of the Board of Education of Carteret County shall be elected by the members of said Board of Education at the first regularly scheduled meeting in January of each year, and the Superintendent of Schools of Carteret County shall ex officio be the Secretary of said Board of Education. The said Board of Education shall continue to exercise all the powers and duties as provided by Chapter 115 of the General Statutes, as amended, or as may be provided by any local Act of the General Assembly applicable to Carteret County. As the terms of office of each of the members expire they shall be nominated and elected by the procedure set forth above and according to the appropriate primary and general election applicable to the situation.

Sec. 6. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 7. This Act shall be in full force and effect from and after its ratification.
