AN ACT TO AMEND THE COUNTY ZONING ENABLING ACT INSOFAR AS IT APPLIES TO MECKLENBURG COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. Section 153-266.10 of the General Statutes of North Carolina is hereby amended by adding the following sentence immediately after the sentence which reads "No such regulations shall affect bona fide farms, but any use of such property for non-farm purposes shall be subject to such regulations.":

"The board of county commissioners, as part of any ordinance adopted pursuant to this Article, may define 'bona fide farm' and 'farm purposes' in such reasonable manner as it may deem wise."

Sec. 2. Section 153-266.17 of the General Statutes is hereby amended by deleting the portion of the first sentence thereof which reads: "If it exercises the powers granted by this Article, the board of commissioners shall provide for the appointment of a board of adjustment consisting of five members, each to be appointed for three years; provided, that" and by substituting the following therefor:

"If it exercises the powers granted by this Article, the board of commissioners shall provide for the appointment of a board of adjustment consisting of such number as, in the discretion of the board of commissioners, will from time to time serve and represent the various portions of the area subject to the exercise of the powers granted by this Article, provided, that the board of adjustment shall consist of not less than five, nor more than thirteen, members and each member shall be appointed for three years and provided, further, that".

Sec. 3. Section 153-266.17 of the General Statutes is further amended by deleting the word "four" in line 57 of the same as it appears in the 1965 Supplement to Volume 3C and by substituting therefor the words "a majority of the".

Sec. 4. This Act shall apply only to Mecklenburg County.

Sec. 5. All laws and clauses of laws in conflict herewith are hereby repealed to the extent of such conflict.

Sec. 6. This Act shall become effective on its ratification.
