AN ACT TO AMEND CERTAIN STATUTES RELATING TO THE MILITIA.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 127-1 is hereby amended by rewriting the first sentence thereof to read as follows:

"The Militia of the State shall consist of all able-bodied citizens of the State and of the United States who are not exempt by reason of aversion to bearing arms, from religious scruples; together with all other ablebodied persons who are, or have or shall have declared their intention to become, citizens of the United States, subject to such qualifications as may be hereinafter prescribed, who shall voluntarily enlist or accept commission, appointment or assignment to duty therein; provided, no female citizen shall be subject to draft into the Militia of the State."

Sec. 2.  G.S. 127-3.1 as the same appears in the 1964 Replacement Volume 3B of the General Statutes is hereby amended by striking out of the next to the last line thereof the letters and figures "G.S. 127-1" and inserting in lieu thereof "G.S. 127-2, G.S. 127-4 or G.S. 127-111".

Sec. 3.  G.S. 127-14 as the same appears in the 1964 Replacement Volume 3B of the General Statutes is hereby amended by:

(1)        The fifth sentence thereof is rewritten to read "He shall make a biennial report to the Governor and to the General Assembly on or before the 30th day of June of each biennium, including a detailed statement of all expenditures made for military purposes during that period."

(2)        The sixth sentence thereof is hereby stricken out.

Sec. 4.  G.S. 127-37 as the same appears in the 1964 Replacement Volume 3B of the General Statutes is hereby amended by striking out of the last line the word "selected" and inserting in lieu thereof "approved".

Sec. 5.  G.S. 127-91 as the same appears in the 1964 Replacement Volume 3B of the General Statutes is hereby amended by inserting the word "State" in the sixth line thereof immediately after the word "against" and before the word "funds".

Sec. 6.  G.S. 127-102 (c) is hereby rewritten to read as follows:

"(c)       There shall be allowed annually to the supply sergeant of each company, battery, troop, detachment, and similar organizations, a sum of money not to exceed the sum of one hundred dollars ($100.00)."

Sec. 7.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 8.  This Act shall be in full force and effect from the date of its ratification.
