SENATE BILL 28
AN ACT TO EXEMPT ADMINISTRATORS APPOINTED FOR THE PURPOSE OF BRINGING AN ACTION FOR WRONGFUL DEATH FROM THE REQUIREMENTS OF FURNISHING A BOND.
The General Assembly of North Carolina do enact:
Section 1. G.S. 28-34 and G.S. 28-49 are both hereby amended by adding the following new paragraph to each:
"No provision in this Chapter shall be construed as requiring a bond of an administrator appointed solely for the purpose of bringing an action for the wrongful death of the deceased; such administrator shall be exempt from the requirements of a bond until such time as he shall receive property into the estate of the deceased."
Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed, except that such laws shall continue in force and effect with respect to bonds obtained by administrators prior to the effective date of this Act.
Sec. 3. This Act shall become effective upon its ratification.
