AN ACT TO AMEND THE CHARTER OF THE CITY OF MORGANTON.

 

The General Assembly of North Carolina do enact:

 

Section 1. From and after the effective date of this Act, Article 3 of Chapter 160 of the General Statutes shall be applicable to all elections held in the City of Morganton.

Sec. 2. The mayor of the City of Morganton shall be paid an annual salary of one thousand two hundred dollars ($1,200.00), payable in equal monthly installments, which shall be in full for all services rendered by him; and the aldermen of the City of Morganton shall each receive an annual salary of nine hundred dollars ($900.00), payable in equal monthly installments.

Sec. 3. The corporate limits of the City of Morganton shall be as follows:

"BEGINNING at the point of intersection of the center line of N. C. Highway 181 and the center line of Catawba River and runs thence down stream in a northerly direction with the meanders of the center line of Catawba River to the point of intersection of the center line of said river with the corporate limits boundary line of Morganton as fixed by the Charter of said city, as amended by Private Laws, Extra Session 1921, Chapter 91, Section 1, and being that boundary line including all the territory situate within one and one-eighth mile of the center of the courthouse, the same being hereinafter designated the Charter boundary line; thence continuing in a northerly direction with said Charter boundary line to a point in the East right of way limit boundary line of Sanford Drive; thence continuing in a northerly direction with the East right of way limit boundary line of Sanford Drive 5,444.29 feet to a concrete monument located over the center line of an outfall sewer line; thence South 73 degrees 21 minutes East to the center line of N. C. Highway 18; thence South with the center line of N. C. Highway 18 to the Charter boundary line; thence the following courses and distances: North 3 degrees 08 minutes West 50 feet, North 23 degrees 05 minutes East 280 feet, South 67 degrees 45 minutes East 169.09 feet, North 7 degrees 47 minutes West 35 feet, North 10 degrees 56 minutes East 347.44 feet, North 48 degrees 10 minutes East 135 feet, North 65 degrees 59 minutes East 500 feet, South 24 degrees 10 minutes East 409.91 feet, South 60 degrees 01 minute East 300.06 feet, South 16 degrees 11 minutes East 535.00 feet to a point in the Charter boundary line; thence in an easterly direction with the Charter boundary line to the West right of way limit boundary line of the Warehouse Road; thence with the West right of way limit boundary line of said road North 01 degrees 11 minutes East 214.37 feet to a concrete monument; thence with the following courses and distances:  North 56 degrees 00 minute West 383.5 feet, North 20 degrees 00 minute East 571 feet, South 84 degrees 00 minute East 350 feet, South 15 degrees West 242 feet, South 83 degrees East 211 feet, South 7 degrees West 30 feet, South 86 degrees 30 minutes East 45 feet, South 15 degrees 30 minutes West 456 feet, West 130 feet to the East right of way limit boundary line of the Warehouse Road; thence with East right of way limit boundary line of said road South 1 degree 11 minutes West 214.37 feet to the Charter boundary line; thence in a southeasterly direction with the Charter boundary line to a point in the South right of way limit boundary line of Southern Railway; thence in a northeasterly direction with said South right of way limit boundary line of Southern Railway right of way 500 feet to a concrete monument; thence southeasterly with the Griffin line to a point in center of Hunting Creek; thence in a southwesterly direction with the meanders of the center line of Hunting Creek to the Charter boundary line; thence in a southwesterly direction with the Charter boundary line to a concrete monument on the southwest side of Bethel Road; thence the following courses and distances: North 48 degrees 24 minutes East 438 feet, South 46 degrees 30 minutes East 244.57 feet, North 51 degrees 28 minutes East 343.66 feet, South 48 degrees 41 minutes 30 seconds East 2670.30 feet, to a point in the center line of East prong of Fiddlers Run Creek; thence with the center line of Fiddlers Run the following courses and distances: South 34 degrees 39 minutes West 1,085 feet, South 18 degrees 3 minutes 30 seconds East 139.98 feet, South 27 degrees 38 minutes 45 seconds West 94.84 feet, South 40 degrees 30 minutes 30 seconds East 374.92 feet, to a point in the center of Fiddlers Run Creek; thence leaving said creek South 52 degrees 40 minutes 30 seconds West 1351.80 feet to a point in the center of West prong of Fiddlers Run; thence upstream and with the meanders of the center of the West prong of Fiddlers Run 4,350 feet to a point in the North right of way limit boundary line of Interstate Highway 40; thence in a westerly direction with the North right of way limit boundary line of Interstate 40 to a point in center of Hunting Creek; thence downstream and with the meanders of Hunting Creek 4,550 feet to the Charter boundary line; thence in a westerly direction with the Charter boundary line to a point in the center of Greenbriar Lane; thence with the center of Greenbriar Lane South 69 degrees 30 minutes West 350 feet to the center of Forest Hill Street; thence with center of Forest Hill Street North 1 degree East 315 feet to the Charter boundary line; thence in a northwesterly direction with the Charter boundary line to a point in center of Cedar Street; thence with the center of Cedar Street to a point in the center of Falls Street; thence with Falls Street South 1 degree 30 minutes West 120 feet to a concrete monument; thence North 88 degrees 32 minutes West 195 feet to an iron pipe; thence North 1 degree 50 minutes East 99.82 feet to South right of way limit boundary line of Cedar Street; thence with South right of way limit boundary line of Cedar Street to East right of way limit boundary line of Ann Street; thence with the East right of way limit boundary line of Ann Street South 1 degree West 160.96 feet to a concrete monument; thence North 88 degrees 40 minutes West 857.69 feet to a point in center of Morgan Branch; thence in a northwesterly direction and with the meanders of the center line of said Morgan Branch to the confluence of Morgan Branch and Asheville Street Branch; thence upstream and with the meanders of Asheville Street Branch in a northeasterly direction 415 feet to the Vernon Franklin property corner; thence with the Vernon Franklin property line North 34 degrees 30 minutes West 232 feet to a concrete monument in southeast right of way limit boundary line of Asheville Street; thence in a northeasterly direction with the southeast right of way limit boundary line of Asheville Street 866 feet to a concrete monument in Charter boundary line; thence in a northwesterly direction with the Charter boundary line to the center line of U. S. Highway 70; thence in a southwesterly and westerly direction with the center line of U. S. Highway 70 to a point opposite from and nearest to the East right of way limit boundary line of Sanford Drive; thence in a northerly direction to the point of intersection of the North right of way limit boundary line of U. S. Highway 70 and East right of way limit boundary line of Sanford Drive; thence in a northwesterly direction with the East right of way limit boundary line of Sanford Drive to a point in center of Silver Creek Road; thence in a westerly direction with the center of the old roadbed of Silver Creek Road to the center of Silver Creek at the old ford; thence in a northerly direction with the meanders of Silver Creek to its confluence with Catawba River; thence downstream and with the center line of Catawba River to the point of BEGINNING.

"Excepting the following:

"(1)      All the State-owned lands on which Broughton Hospital and North Carolina School for the Deaf are located.

"(2)      The land of T. H. Sain at intersection of U. S. Highway 70 and Walton Road.

"(3)      The land of Mrs. Jerry Poovey and Donald C. Buff on Greenbriar Lane."

Sec. 4. The territory embraced within the corporate limits of the City of Morganton shall be divided into four wards, as hereinafter described, which shall not be changed except by an Act of the General Assembly. Provided, however, that in the event the corporate limits of the City of Morganton are extended, the Board of Elections shall enlarge the nearest ward so as to include the annexed area therein. The four wards shall be as follows:

Ward No. 1: BEGINNING at the intersection of the center line of Sterling Street and the center line of Union Street; and running thence northwesterly with the center line of Sterling Street to the center line of North Green Street; thence westerly with the center line of North Green Street to the corporate limits of the City of Morganton; thence northerly and easterly with the corporate limits of the City of Morganton to the intersection of the center line of East Union Street and the corporate limits of the City of Morganton; thence southwesterly with the center line of East Union Street to the BEGINNING.

Ward No. 2: BEGINNING at the intersection of the center line of Union Street and the center line of Sterling Street; and running thence northeasterly with the center line of East Union Street to the point where the center line of East Union Street intersects with the corporate limits of the City of Morganton; thence southerly with the said corporate limits of the City of Morganton to the intersection of said corporate limits with the center line of South Sterling Street; thence northwesterly with South Sterling Street to the place of BEGINNING.

Ward No. 3: BEGINNING at the intersection of the center line of Union Street and the center line of South Sterling Street; and running thence southeasterly with the center line of South Sterling Street to the point where the center line of South Sterling Street intersects with the corporate limits of the City of Morganton; thence with the corporate limits of the City of Morganton as the said line of corporate limits runs first in a southerly direction, then in a westerly direction, then in a northerly direction, and then in a westerly direction until it intersects with the center line of West Union Street; thence with the center line of West Union Street to the point and place of BEGINNING.

Ward No. 4: BEGINNING at the intersection of the center line of West Union Street and the center line of Sterling Street and running thence with the center line of West Union Street southwesterly to the point of intersection of the center line of said street with the corporate limits of the City of Morganton; thence with said corporate limits westerly, and then in a northerly direction to the intersection of said corporate limits with the center line of North Green Street; thence with the center line of North Green Street southeasterly to the point where the center line of said street intersects with the center line of Sterling Street; thence with the center line of Sterling Street southeasterly to the point and place of BEGINNING.

The following are excepted from the foregoing wards:

(1)       All the State-owned lands on which Broughton Hospital and North Carolina School for the Deaf are located.

(2)       The land of T. H. Sain at intersection of U. S. Highway 70 and Walton Road.

(3)       The land of Mrs. Jerry Poovey and Donald C. Buff on Greenbriar Lane.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. Section 2 of this Act shall be effective on and after July 1, 1967, and the remainder of this Act shall be effective on and after the date of its ratification.
