AN ACT TO AUTHORIZE THE CITY OF MONROE TO DISPOSE OF OR PUT TO DIFFERENT USES CERTAIN PROPERTY OF THE CITY.

 

The General Assembly of North Carolina do enact:

 

Section 1. The City of Monroe is hereby authorized to dispose of or put to any entirely different and inconsistent use from that for which it has been used all or any part of either of the following described properties:

(a)       Old Sewage Treatment Plant property-a tract of land located in Monroe Township, Union County, North Carolina on both sides of Roosevelt Boulevard and bounded on the South by other property of the City of Monroe, on the West by Roy Walters and Robert 0. Helms, on the North by I. F. Plyler, and on the East by Dr. S. A. Alexander, and more particularly described as follows:

BEGINNING at an iron stake a new corner of the City of Monroe property on the Dr. S. A. Alexander line and runs thence a new line North 55 degrees 21 minutes West 758 feet to a point in the center of Bearskin Creek, a new corner with the Roy Walters property, and runs along the center of Bearskin Creek seven (7) calls as follows: First, with the Walters property North 55 degrees East 380 feet; second, with a line of Robert 0. Helms North 12 degrees 45 minutes East 336.6 feet; third, continuing with the Helms line North 2 degrees 30 minutes West 440.8 feet to an iron, I. F. Plyler's line; fourth, with Plyler's line South 54 degrees 15 minutes East 258.7 feet; fifth, North 86 degrees 30 minutes East 191.4 feet; sixth, North 79 degrees East 132 feet; seventh, South 29 degrees East 363 feet; thence South 78 degrees 15 minutes West 151.8 feet; thence along and with Dr. S. A. Alexander's line South 17 degrees 45 minutes West 1001 feet to the point of beginning.

(b)       Ellen Fitzgerald Hospital property-the following described property lying and being in Monroe Township, Union County, North Carolina and more particularly described as follows:

BEGINNING at a point in the northerly margin of Morrow Avenue, said point being located South 89 degrees 30 minutes East 14 feet from the intersection of the northerly margin of Morrow Avenue and the easterly margin of Hayne Street in the City of Monroe; thence North 0 degree 30 minutes East 196.4 feet to an iron, the southwesterly corner of the property of C. M. Shannon Estate (now or formerly); thence South 89 degrees 30 minutes East 190 feet to an iron at the southeasterly margin of the property of C. M. Shannon Estate; thence with the westerly margin of Beasley Street South 0 degree 30 minutes West 196.4 feet to a point formed by the intersection of the westerly margin of Beasley Street and the northerly margin of Morrow Avenue; thence North 89 degrees 30 minutes West 190 feet to the point of beginning.

Sec. 2. If the City of Monroe elects to sell all or any part of either or both of the above-described tracts, then it may use the proceeds from said sale for any entirely different and inconsistent use from that for which the property has been used.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be effective upon its ratification.
