AN ACT TO ELIMINATE THE PROVISIONS FOR DOUBLE INDEXING OF INSTRUMENTS IN ACCORDANCE WITH THE FORMER LAW RELATING TO REGISTRATION OF SECURITY INTERESTS IN PERSONAL PROPERTY.

 

WHEREAS, the Uniform Commercial Code, as enacted in this State, makes new provisions for the filing of papers with regard to security interests in personal property; and

WHEREAS, the former practice of double indexing instruments primarily relating to real property but also containing personal property is no longer proper; and

WHEREAS, G.S. 161-22, relating to the conduct of the office of the register of deeds, contains a provision requiring such double indexing, which is in conflict with the Uniform Commercial Code: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 161-22 is hereby amended by striking out the words:

"Provided, further, that it shall be the duty of the register of deeds of each county, in which there is a separate index for conveyances of personal property and for those of real estate, to double index every such conveyance, provided that such conveyance shall contain both species of property."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective at midnight, June 30, 1967.
