HOUSE BILL 1220

 

 

AN ACT AMENDING G.S. 44-49, RELATING TO LIENS UPON RECOVERY FOR PERSONAL INJURIES, SO AS TO REQUIRE PHYSICIANS, HOSPITALS AND OTHERS TO FURNISH TO ATTORNEYS REPRESENTING THE INJURED PERSON CERTAIN MEDICAL RECORDS AND REPORTS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 44-49 is amended by adding at the end of the second unnumbered paragraph thereof the following:

"and further provided that the physician, dentist, trained nurse, hospital or such other person as has a lien hereunder shall, without charge to the attorney as a condition precedent to the creation of such lien, furnish upon request to the attorney representing the person in whose behalf the claim for personal injury is made, an itemized statement, hospital record, or medical report for the use of such attorney in the negotiation settlement or trial of the claim arising by reason of the personal injury."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall not affect any civil action filed prior to September 1, 1967.

Sec. 4.  This Act shall become effective upon its ratification.
