SENATE BILL 744

 

 

AN ACT CREATING A STATUTE OF LIMITATIONS FOR COMMENCEMENT OF ACTIONS RELATING TO CERTAIN ROADS AND STREETS IN SMITHVILLE TOWNSHIP, BRUNSWICK COUNTY.

 

WHEREAS, it was necessary to relocate a major part of the State highway in the western extremity of Smithville Township in Brunswick County; and

WHEREAS, certain streets, alleys and roadways in said western extremity of Smithville Township, Brunswick County, as platted in Book of Maps 3, page 113, in the office of the Register of Deeds of Brunswick County, were withdrawn from dedication by consent of all property owners in that certain instrument entitled "Agreement of Withdrawal from Dedication and Conveyance" dated July 20, 1961, and recorded in the office of the Register of Deeds of Brunswick County in Book 158 at page 570, on or about September 13, 1961; and

WHEREAS, it is deemed desirable to limit the time within which any claim or demand or cause of action could or might be made to challenge or set aside said withdrawal from dedication of said originally platted streets, alleys and roadways: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1. No action to affect title or interest in or to any street, alley or roadway withdrawn from dedication by that certain Agreement of Withdrawal from Dedication and Conveyance recorded in Book 158, Page 570, in the office of the Register of Deeds of Brunswick County, shall be brought or maintained in any court in this State on or after January 1, 1968.

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
