AN ACT TO EXEMPT FROM TAXATION THE REAL AND PERSONAL PROPERTY OF AIRPORT AUTHORITIES, AIRPORT BOARDS AND AIRPORT COMMISSIONS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 105-296 is hereby amended by redesignating the present subparagraph (13) and (14) and by adding a new subparagraph (13) to read as follows:

"(13)    Real property owned by any airport authority, airport board or airport commission created as a separate and independent body corporate and politic by an act of the General Assembly or by counties or municipalities pursuant to an act of the General Assembly."

Sec. 2.  G.S. 105-297 is hereby amended by adding thereto a new subparagraph to be designated "(14)" and to read as follows:

"(14)    Personal property owned by any airport authority, airport board or airport commission created as a separate and independent body corporate and politic by any Act of the General Assembly or by counties and/or municipalities pursuant to an act of the General Assembly."

Sec. 3.  Article 6 of Chapter 63 of the General Statutes of North Carolina is hereby amended by adding a new Section to be numbered "§ 63-51.1" and to read as follows:

"§ 63-51.1.  Tax Exemptions. Any airport authority, airport board or airport commission created as a separate and independent body corporate and politic by an act of the General Assembly or by counties and/or municipalities pursuant to an act of the General Assembly shall be exempt from the payment of any taxes or fees upon its real and personal property to the State or any subdivision thereof. For the purpose of such tax exemption, it is hereby declared as a matter of legislative determination that an authority so created is and shall be deemed to be a municipal corporation and all property owned by said authorities, boards and commissions shall be deemed to be held for a public purpose."

Sec. 4.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 5.  This Act shall become effective January 1, 1968.
