AN ACT TO AMEND ARTICLE 14A OF CHAPTER 160 OF THE GENERAL STATUTES OF NORTH CAROLINA SO AS TO MAKE CERTAIN PROVISIONS THEREOF APPLICABLE TO FORSYTH COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 160-181.7 is amended by adding a new paragraph to the end thereof to read as follows:

"Provided, however, no county shall exercise the authority granted by this Article with respect to any specific tract of real property until such action is authorized by resolution approved by at least four-fifths of the membership of the governing body thereof. Provided further, no municipality shall exercise the authority granted by this Article with respect to any specific tract of real property until such action is authorized by resolution approved by at least three-fourths of the members of the governing body thereof."

Sec. 2. G. S. 160-181.9 is amended by adding the following sentence to end thereof:

"For the purpose of this Article 'open space' or 'open area' is further defined as a tract of real property consisting of at least ten acres in area."

Sec. 3. G. S. 160-181.10 is amended by deleting from line three thereof the following: "Forsyth County,".

Sec. 4. The provisions of this Act shall apply to Forsyth County only.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall become effective upon its ratification.
