AN ACT TO AMEND G.S. 33‑42.1 RELATING TO THE REQUIREMENT THAT GUARDIANS EXHIBIT SECURITIES AND BANK STATEMENTS TO THE CLERK OF SUPERIOR COURT.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 33‑42.1 is hereby amended by striking out the period at the end of the Section, inserting a colon in lieu thereof, and adding the following words:

"Provided, such examination may be made by the Clerk of the Superior Court of the county in which such guardian resides or the county in which such securities are located and, when the guardian is a duly authorized bank or trust company, such examination may be made by the Clerk of the Superior Court of the county in which such bank or trust company has its principal office or in which such securities are located; the certificate of the Clerk of Superior Court of such county shall be accepted by the Clerk of the Superior Court of any county in which such guardian is required to file an account."

Sec. 2.  All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
